Terms and Conditions

1. Introduction and Agreement

  • The terms and conditions below apply to all users and customers of Embercraft.co.uk.
  • By using the website or making a purchase, users agree to these terms.

2. Terms of Use

  • www.Embercraft.co.uk is for browsing and shopping for Embercraft products, in addition to communicating with the business owner.
  • Illegal or harmful activities are prohibited.

3. Product Information and Availability

  • While we strive for accuracy, our products are hand made and may differ slightly from those pictured, If you want pictures of the exact product you will receive, this can be arranged, please get in touch.
  • Products may not always be available, there may also be cases where time is required to make a product after you have ordered. This may result in you receiving the product later than expected.

4. Order Process and Payment Terms

Order Process

  • Browse our extensive collection of forged board games and dice in our online shop.
  • Add your desired items to your cart and review your selections.
  • Proceed to checkout, where you can enter your shipping information.
  • Choose your preferred shipping method and complete your secure payment.
  • You'll receive an email confirmation with your order details shortly after.

Payment Terms

We accept all major credit cards, debit cards, and secure digital wallets for your convenience.  Your payment information is protected by our secure payment processing system.

All prices are listed in £ and are exclusive of applicable taxes, which will be added at checkout based on your shipping destination.

Order Cancellation

Orders can be cancelled free of charge before they are shipped.  Please contact us if you wish to cancel your order.

5. Shipping and Delivery

  • If your chosen product is in stock, we will aim to post it within 5 working days, this will be handled  by royal mail using the method requested/selected at checkout.
  • When ordering for delivery outside of the UK, please get in touch for a quote on postage costs.
  • Embercraft does not accept liability for delays or damage caused by third-party carriers.

6. Returns and Refunds

  • For faulty or incorrect items, customers can request a repair, replacement, or a full refund depending on the situation and time-frame:
  • Up to 30 days: If the fault is discovered within 30 days of receiving the goods, the customer may return the product and receive a full refund.
  • Up to 6 months: If the fault arises after  30 days but within 6 months, we will offer to repair or replace the product. If a repair or replacement isn't possible, the product can be returned for a refund.
  • Beyond 6 months:  After 6 months, things  get a bit more complex. The burden of proof falls on the customer to demonstrate the item was faulty at the time of purchase. They may still  be entitled to a partial refund depending on the circumstances.
  • Change of Mind (Distance Selling):  For online purchases over £42, customers have a 14-day "cooling-off" period under the Distance Selling Regulations. They can cancel their order and get a full refund within this time frame, no reason needed.  They have a further 14 days to return the goods after informing the seller of cancellation.
  • Please note the above may not apply to damage caused by misuse of the product, intentionally or otherwise.

7. Intellectual Property

  • All content on Embercraft.co.uk belongs exclusively to Embercraft and should not be shared without prior consent and recognition of origin.

8. Limitation of Liability

Embercraft will strive to provide accurate information and high-quality products. However, we cannot guarantee:

  • That our website will always be available or error-free.
  • That our products will be completely free of defects or imperfections.
  • That the information on our website will be entirely accurate or up-to-date.

Our Liability to You

In no event shall Embercraft be liable for any:

  • Indirect, incidental, or consequential damages arising out of or related to your use of our website or products.
  • Loss of profits, revenue, data, or business opportunity arising out of or related to your use of our website or products.

Our Maximum Liability

Our total liability to you for any damages arising out of or related to your use of our website or products, regardless of the legal theory (including contract, warranty, or tort), is limited to the total amount you paid for the products in question.

Disputes:

 Direct Communication:

  •  Often, the simplest solution is to try resolving the issue directly with Embercraft.  They outline their return policy clearly, so if the issue falls under those parameters (faulty product, unwanted item within the return window), contacting them for a replacement or refund might be sufficient.

  • Alternative Dispute Resolution (ADR):  The UK offers ADR services for resolving disputes outside of court. These can be faster and less expensive than litigation. Options include mediation, where a neutral third party helps facilitate communication, or arbitration, where a neutral third party makes a binding decision.

How to Make a Return:

  1. Contact us via email at Embercraftforge@gmail.com within the specified time frame, stating your intention to return the item(s) and the reason for return.
  2. We will provide you with a return address and any further instructions.
  3. Once we receive the returned item(s) and confirm they meet the conditions outlined above, we will process your refund or replacement within 14 days.

Exclusions:

  • This policy applies to Embercraft products only. It does not cover any third-party products sold on our website.
  • We reserve the right to refuse returns  that do not comply with this policy, including items that are damaged due to misuse or neglect.
